Article 1 – Definitions
- Landlord: The owner or manager of the holiday villa.
- Tenant: The person renting the holiday villa.
- Holiday Villa: The rented accommodation in Southern Spain.
- Rental Agreement: The agreement between the landlord and the tenant regarding the rental of the holiday villa.
Article 2 – Reservation and Payment
- A reservation is only final after written confirmation from the landlord and receipt of a 25% deposit of the total rental amount.
- The remaining amount must be paid no later than 2 weeks before arrival.
- For bookings made within 2 weeks of arrival, the full rental amount must be paid immediately.
- Payments must be made to account number NL18 SNSB 0938 436 325 in the name of M.G.M Veenstra.
Article 3 – Deposit
- The tenant must pay a deposit of €350 together with the final payment of the rental amount.
- Any damage or defects must be reported to the landlord of the villa as soon as they are noticed.
- The deposit will be refunded within 7 days after departure, provided there is no damage to the villa or inventory.
- Any damage or loss of inventory will be deducted from the deposit. If the damage exceeds the deposit, the tenant is liable for the remaining amount.
Article 4 – Final Cleaning
- A mandatory final cleaning is performed by the landlord and costs €200.
- The costs of the final cleaning must be paid in cash upon arrival at the holiday villa
- The tenant must leave the villa in a tidy condition, placing any dirty dishes in the dishwasher. Opened food packaging must be taken along with the remaining trash and disposed of in the designated containers.
Article 5 – Arrival and Departure
- Check-in is possible from 4:00 PM on the day of arrival.
- Check-out must be done by 10:00 AM on the day of departure.
- Late departure or early arrival is only possible after consultation and approval by the landlord.
Article 6 – Cancellation Policy
- Cancellation up to 6 weeks before arrival: 30% of the total rental amount will be withheld.
- Cancellation between 6 and 2 weeks before arrival: 70% of the total rental amount will be withheld.
- Cancellation within 2 weeks before arrival: 100% of the rental amount is due.
- The landlord advises the tenant to take out travel and cancellation insurance.
Article 7 – Use of the Villa and the Pool
- The villa is exclusively for recreational stay and may not be sublet.
- The maximum number of guests allowed is 8 persons and may not be exceeded.
- The tenant must comply with the applicable house rules and any regulations of the municipality or residence.
- Pets are not allowed, unless agreed upon in writing with the landlord in advance.
- Smoking inside the villa is not allowed.
- Pool rules:
• Plastic plates and plastic glasses must be used around the pool at all times to prevent glass shards and accidents.
• Pool use is at the tenant’s own risk. Children must always be supervised by an adult.
• Diving is not allowed.
• The tenant must respect any quiet hours in the area regarding the use of the pool.
Article 8 – Energy and Water Consumption
- Normal energy and water consumption is included in the rental price.
1a. Normal use of energy and water is defined as an average consumption of 20 kWh of electricity and 4 m³ of water on a 24-hour basis. - If excessive use is detected (e.g., air conditioning left on for long periods when absent), the landlord reserves the right to charge an additional fee for the extra consumption.
Article 9 – Liability
- The landlord is not liable for:
• Accidents, injuries, or illnesses during the stay.
• Theft, loss, or damage to the tenant’s property.
• Force majeure situations (e.g., extreme weather conditions or government measures). - The tenant is liable for damage caused by negligence or intentional actions.
Article 10 – Complaints and Disputes
- Any complaints must be reported to the landlord immediately so that a solution can be sought.
- Disputes should preferably be resolved through mutual agreement. If this is not possible, Dutch law will apply.
By paying the deposit, the tenant agrees to these terms and conditions.
