Article 1 – Definitions

  1. Landlord: The owner or manager of the holiday villa.
  2. Tenant: The person renting the holiday villa.
  3. Holiday Villa: The rented accommodation in Southern Spain.
  4. Rental Agreement: The agreement between the landlord and the tenant regarding the rental of the holiday villa.

 

Article 2 – Reservation and Payment

  1. A reservation is only final after written confirmation from the landlord and receipt of a 25% deposit of the total rental amount.
  2. The remaining amount must be paid no later than 2 weeks before arrival.
  3. For bookings made within 2 weeks of arrival, the full rental amount must be paid immediately.
  4. Payments must be made to account number NL18 SNSB 0938 436 325 in the name of M.G.M Veenstra.

 

Article 3 – Deposit

  1. The tenant must pay a deposit of €350 together with the final payment of the rental amount.
  2. Any damage or defects must be reported to the landlord of the villa as soon as they are noticed.
  3. The deposit will be refunded within 7 days after departure, provided there is no damage to the villa or inventory.
  4. Any damage or loss of inventory will be deducted from the deposit. If the damage exceeds the deposit, the tenant is liable for the remaining amount.

 

Article 4 – Final Cleaning

  1. A mandatory final cleaning is performed by the landlord and costs €200.
  2. The costs of the final cleaning must be paid in cash upon arrival at the holiday villa
  3. The tenant must leave the villa in a tidy condition, placing any dirty dishes in the dishwasher. Opened food packaging must be taken along with the remaining trash and disposed of in the designated containers.
 

Article 5 – Arrival and Departure

  1. Check-in is possible from 4:00 PM on the day of arrival.
  2. Check-out must be done by 10:00 AM on the day of departure.
  3. Late departure or early arrival is only possible after consultation and approval by the landlord.
 

Article 6 – Cancellation Policy

  1. Cancellation up to 6 weeks before arrival: 30% of the total rental amount will be withheld.
  2. Cancellation between 6 and 2 weeks before arrival: 70% of the total rental amount will be withheld.
  3. Cancellation within 2 weeks before arrival: 100% of the rental amount is due.
  4. The landlord advises the tenant to take out travel and cancellation insurance.
 

Article 7 – Use of the Villa and the Pool

  1. The villa is exclusively for recreational stay and may not be sublet.
  2. The maximum number of guests allowed is 8 persons and may not be exceeded.
  3. The tenant must comply with the applicable house rules and any regulations of the municipality or residence.
  4. Pets are not allowed, unless agreed upon in writing with the landlord in advance.
  5. Smoking inside the villa is not allowed.
  6. Pool rules:
    • Plastic plates and plastic glasses must be used around the pool at all times to prevent glass shards and accidents.
    • Pool use is at the tenant’s own risk. Children must always be supervised by an adult.
    • Diving is not allowed.
    • The tenant must respect any quiet hours in the area regarding the use of the pool.
 

Article 8 – Energy and Water Consumption

  1. Normal energy and water consumption is included in the rental price.
    1a. Normal use of energy and water is defined as an average consumption of 20 kWh of electricity and 4 m³ of water on a 24-hour basis.
  2. If excessive use is detected (e.g., air conditioning left on for long periods when absent), the landlord reserves the right to charge an additional fee for the extra consumption.
 

Article 9 – Liability

  1. The landlord is not liable for:
    • Accidents, injuries, or illnesses during the stay.
    • Theft, loss, or damage to the tenant’s property.
    • Force majeure situations (e.g., extreme weather conditions or government measures).
  2. The tenant is liable for damage caused by negligence or intentional actions.
 

Article 10 – Complaints and Disputes

  1. Any complaints must be reported to the landlord immediately so that a solution can be sought.
  2. Disputes should preferably be resolved through mutual agreement. If this is not possible, Dutch law will apply.

          By paying the deposit, the tenant agrees to these terms and conditions.
